The following Terms and Conditions shall apply exclusively to the business relationship between SpinDealz Inc, all subsidiaries of SpinDealz Inc, it’s internet platform www.spindealz.com (“SpinDealz” “The Website” “We” “Us”), and the end user (“You” or “Your”).  By using SpinDealz, you accept these terms and conditions, as well as the manner in which SpinDealz operates.

Advice listed on SpinDealz.com are only recommendations and are not intended to be guidelines or rules.  SpinDealz is not liable nor responsible for the actions of the users or other person having read or been told about such advice.   

Any promotions run by SpinDealz shall only be valid if they are announced on the website or corresponding email and are only valid for a limited time.

Acceptance of Terms and Conditions

By using Spindealz you consent to the practices of SpinDealz described in the privacy policy and the terms and conditions and are bound by these.  If you do not agree to the terms and conditions, do not use SpinDealz.  You acknowledge that you have had the opportunity to read our “FAQ” section as well as ask questions regarding to the use of SpinDealz and practices of SpinDealz.

Changes to Terms and Conditions

SpinDealz may add, delete or amend the terms and conditions at anytime by posting on SpinDealz.  If changes to the terms and conditions occur, SpinDealz may provide you with a notice of such changes in any of the following ways: via an email from SpinDealz or mail out to the address provided during your account registration.

Eligibility

By accepting to the terms and conditions and/or registering with SpinDealz, you confirm you are at least 18 years of age and at least age of majority under applicable laws in the state in which you reside.  SpinDealz currently offers services to the contiguous 48 states.

SpinDealz employees and their family members and any person residing in the same household as any SpinDealz employee may not participate in SpinDealz auctions. SpinDealz reserves the right limit the number of user accounts per household and the number of won auctions per user account.  Limit 1 account per household.

Auction Limits

SpinDealz permits 7 wins in a 28 day period, and 3 wins per 24 hour period.  Additional auction limits include one win of the same item over $299.00 in a value during a 28 day period.  Only one win of any item over $699.00 in a 28 day period is allowed.  All bids, purchased or promotional, apply to these limits.

For example, if you win an XBOX 360 250GB (299.99), you will not be able to bid on any XBOX 360 250GB for the following 28 days.  These limits allow more users to receive huge savings on that items that SpinDealz offers.

Purchasing Bids

Bids are purchased in advance in the form of “Bid Packs.”  After registering for a free account, click the “Buy Bids” button from the top menu.  Our bid packages offer bids starting at $0.59 cents per bid and as low as $0.50 cents per bid.

Placing Bids

You can place bids in two ways:

·         Manual Bids – You can manually click an auctions “Bid” button and one bid will be deducted from your available bids. 

·         Auto Bid – We understand that penny auctions can be unpredictable, and that you may need to leave SpinDealz from time to time, which is why we have the Auto Bid feature.  Auto Bid will places bids for you while you are away!  Simply enter the number of bids you would like to place (maximum 25, minimum 3), and the BID TO price, which is the maximum price you would like to pay for the item, and click “Set Auto Bid”.  You will receive a confirmation message when Auto Bid has been activated successfully.  You also have the option to deactivate Auto Bid if you change your mind. 

How an Auction Works

Each auction has a specified timer, which can be 10, 15, or 20 seconds.  When a user bids on the item, time is added to the auction timer.  For example, if an auction has a 10-second timer and there are 3 seconds remaining for the auction to expire, the timer will reset to 10 seconds if a user places a bid before the auction expires.  This gives all users a chance to participate in auctions and to get a chance at winning items at heavily discounted prices!   

Multi Bid Auctions

SpinDealz offers promotional Multi-bid auctions in which we offer free bids for all users!  Multi-Bid auctions include Quad-Bid, Triple-Bid, and Double-Bid auctions.  All users receive free bids until a special reserve auction price is met.  For example, in a Quad-Bid auction, all users will receive 3 free bids for each bid placed until the reserve sales price is met.  The reserve sales price is not disclosed, and the free bids promotion expires when the auction item’s price meets the reserve price.  This means you should not hesitate and place bids to receive as many free bids as possible!

SpinIt Auction

SpinDealz is the only penny auction site in which we offer to purchase the item back from the auction winner.  If you win an auction and for any reason you decide you no longer want the item, you can “SpinIt”, and SpindDealz will offer to purchase the item from you at MSRP value!

For example, if you won a Notebook with an MSRP value of $499.99 and you decide to “SpinIt”, SpinDealz will offer to purchase the item at MSRP value, minus the final selling price of the item, and minus shipping and handling.  If the Notebook auction ended with a selling price of $499.99, then SpinDealz will offer you $499.99 - $99.99 - $5.95 (s/h) = $394.05!  SpinDealz will pay the user in the form of certified check, which will be mailed via United States Priority Mail.  However, you may wish to continue checkout and choose not to SpinIt.  This offer does not apply to all auctions, and only applies to “SpinIt” auctions.  “SpinIt” auctions are strictly promotional and offered at limited times. 

 Winning an Auction

An auction ends when the auction timer reaches zero on SpinDealz’s servers.  You will have 7 calendar days to confirm and pay for your item, otherwise the item is forfeited.  When an auction ends, you will be redirected to our checkout page where you can confirm and pay for the item.

You will have the opportunity to review the final payment including shipping and handling. After payment you will receive a payment confirmation email.  Once the item ships, an email confirmation will be sent.

Technical Errors & Unforseen Circumstances

Spindealz strives to produce the best user experience for every user and fan of penny auctions. However, occasionally technical glitches and/or uncontrollable circumstances will occur, which will result in voided auctions. Spindealz will do the upmost to provide every user proper resolution regarding bids that were used in voided auctions. Spindealz reserves the right to void any auction that is deemed to have suffered technical errors. Spindealz reserves the right to refund and/or credit bids to users who have placed bids on such auctions.

Payments

SpinDealz is currently partnered with PayPal to offer a quick and convenient way to pay for Bid Packages and items that you may have won.  We do not require that you have a PayPal account, and can continue check-out using Visa, MasterCard, American Express, and Discover through the PayPal check-out process. 

SpinDealz uses a secure connection to process payments with the help of Trustwave, a verified provider of 256-bit SSL security.  At our check-out pages, you will notice a padlock symbol in your browser.  In addition, a secure session begins with “HTTPS” instead of just “HTTP”.  Both items indicate that the page and session is secure.

Shipping / Returns

You will be allowed to save one shipping address to your account.  You may also modify your address in your account if necessary.  SpinDealz will only ship to addresses associated with your account.  You may change your shipping address at anytime by clicking the “edit” button next to your current address.    Delivery times may vary, therefore any time provided is only a guide.  SpinDealz works very hard to have all items out within 3 business days of when payment is received.  Damage to the item from transport or packing must be reported to SpinDealz upon receipt.   SpinDealz currently only ships to the contiguous 48 states.  We plan to expand in the future so that everyone can enjoy great savings!

Each auction item has the return policy stated on the auction item’s product page.  Return policies vary from item to item so please be sure to check the item’s product page for the complete details. 

My Account

During registration you will be required to choose a user name.  This user name will be displayed and provided to the public.  The username must meet the requirements set by SpinDealz. 

You are permitted to change your password under your control panel.  You will be asked to  enter your current password as well as your new password. If you forget your user name and/or password, you may use the “forgot password” link located on the top right corner of the website.

SpinDealz does not allow usernames to be modified after registering an account.  Your username will be visible to others during live auctions, therefore you should avoid having a username which could be offensive to others.  SpinDealz reserves the right to cancel any accounts to which its username could be offensive.  Profanity or racial slurs of any kind will not be tolerated and will lead to a permanent ban from SpinDealz.  

Registering multiple accounts is prohibited and is a violation of the Spindealz usage policy.   Any items won using illegal accounts are void and no refunds will be granted.

Closing Your Account

Upon request, SpinDealz will close your account as soon as reasonably possible, based on your account activity and in accordance with applicable law.  We reserve the right to keep personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations and enforce our terms and conditions and take other actions otherwise permitted by law.
